Terms of Use

IMPORTANT NOTE:
The Terms of Use ("Terms") are the terms entered into between you (an individual, company or any other entity) and WonderMaker (as described in the "About WonderMaker" subsection) in connection with the use of the Product (as defined in Article 1(a) of these Terms). Terms of Use of the Product (as defined in Section 1(a) of these Terms). You must be the legal age of majority in your jurisdiction to access and enter into these Terms. If you are under the legal age of majority, your guardian's consent or execution of these Terms is required. Please read these Terms carefully before using your WonderMaker Product. Your use of your WonderMaker Product will be deemed to be your agreement to be bound by the conditions described in these Terms. If you do not agree to these Terms, do not use any WonderMaker Product. Subject to the Merchandise Return Policy, you may return a WonderMaker Product to the store, or authorized distributor, or retail store from which you purchased the device at that time for a refund. You should note, however, that refunds to retail stores may also be subject to the store's return requirements. Merchandise return policies are subject to the laws and regulations of the country of purchase. You may review a copy of these Terms at any time by visiting the WonderMaker website at https://www.wondermaker3d.com and may retain a copy of these Terms for future reference.
About WonderMaker
If you are located in China, "WonderMaker" refers to "Zhejiang WonderMaker 3D Technology Co.,Ltd.
If you are located in any other country, "WonderMaker" refers to "WonderMaker".
1. General Provisions

1.1 The Products Referred to in This Clause Are:
- the WonderMaker Device and the software contained therein, wherein the software includes, but is not limited to, code and other embedded software stored on the WonderMaker Device, documentation, interfaces, content, fonts, and any data protected by copyright of WonderMaker or its licensors;
- Updates or upgrades to the products referred to in paragraph 1 of this article.

1.2 Unless otherwise agreed, the Software contained in these Terms shall be governed by these Terms, whether it is stored in read-only memory, any other medium or in any other form, or whether it is downloaded online from a location licensed by WonderMaker.
2. End-user Software Licenses
Subject to these Terms, you have the right to use the Software (as defined in Section 1(a)(1)) on a single WonderMaker Device or computer on a limited, non-exclusive basis and may not sell, transfer or use it for any other commercial purpose.
3. Your Obligations
By using this product and agreeing to these terms, you warrant:

3.1 WonderMaker's technology or intellectual property may not be used to develop software or to design, develop, manufacture, sell or license third party equipment/accessories associated with WonderMaker's product equipment without WonderMaker's prior permission.

3.2 You may make one copy of the Software and save it on your computer's hard disk or other storage media for archival purposes. However, the Software may not be distributed or made available over a network such that it is available for use on more than one device or more than one computer at a time.

3.3 You may not sell, rent, lease, loan, sublicense or distribute the Software, in whole or in part, to a third party without the prior written permission of WonderMaker. However, you may transfer the entire license to the Software to another party in a single, perpetual transfer at the same time as you transfer the WonderMaker equipment, provided that:
- The transfer must include your product WonderMaker device and all software contained therein;
- no backup of all or part of the software shall be retained;
- the party receiving the WonderMaker product has read and agrees to be bound by these Terms.

3.4 Unless otherwise expressly permitted, you shall not, and will not permit any other person to, engage in any misuse, intrusion or other improper use of the Product, including modifying, decoding, reproducing, disassembling, publishing, publicly transmitting, reverse engineering, decompiling, derailing, disassembling or creating derivative works of the Software in any way.

3.5 In addition, you agree not to use the Product and related Updates to engage in the following behaviors:
- reproduce or use any part of the contents of this product outside the scope of the authorization granted herein;
- provide to a third party, or allow a third party to use, all or part of the Software (including, but not limited to, applications, services, code, source code, etc., operated under the Service) without WonderMaker's written permission;
- use the product in a deceptive manner or for a deceptive purpose;
- remove any of the copyright notices and notices contained in this product;
- attempt to disrupt, bypass, alter, nullify or evade any digital rights management system associated with and/or integral to the Product;
- Other improper or contrary to law.

3.6 You will need to obtain authorization from the relevant rights holder in a particular country or region when using the Products for storage or reproduction. The material copying functionality provided by the WonderMaker Product is limited to copying material that is not protected by copyright, that is copyrighted by you, or that you are authorized or legally permitted to copy. You understand that the ownership and intellectual property rights in any material displayed, stored or accessed through your device belong to the owner of that material. Such materials may be protected by copyright or other intellectual property laws and treaties and may be subject to the use agreements or terms of use of third parties that provide such materials. Unless otherwise agreed, these Terms do not grant you any rights to use such materials, nor do they guarantee your continued use of such materials.

3.7 If you choose to provide suggestions in connection with the Product ("Feedback"), you hereby grant to WonderMaker an unrestricted, perpetual, irrevocable, non-exclusive, fully paid-up, royalty-free, and without further notice right to use such Feedback in any way and for any purpose whatsoever, including improving the Product and creating other products and services. purpose, including to improve this product and create other products and services.

3.8 You agree to use the Products in compliance with all applicable laws and regulations of the country or region in which the Products reside or are used, including but not limited to the local laws of the country or region in which you reside or download or use the Products and Services.
4. Reservation of Rights
WonderMaker and its licensors enjoy and retain intellectual property and other rights and title to the visual interface, graphics, design, firmware, software, services, and all other elements of the Products, and reserve any other rights not expressly granted to you in these Terms.
5. Privacy Policy
The WonderMaker Privacy Policy ("Privacy Policy") provides information about the data WonderMaker collects and how WonderMaker uses that data. When you use the Product, WonderMaker will collect data from your device in accordance with these Terms and the Privacy Policy. You can find details of the Privacy Policy at https://www.wondermaker3d.com.
6. Utilization Data

6.1 If you choose to help WonderMaker enhance its products and services, WonderMaker and its affiliates/licensees may collect data from your device for analysis. The data collected includes your device configuration data, application statistics and error log data. All data is anonymized before it is collected and processed.

6.2 WonderMaker ensures an approximate and adequate level of protection for your data as required by all applicable laws and regulations. When you use the Device, data collected from your Product Device may be processed or transferred to WonderMaker and its affiliates/licensees located in countries other than the country in which you reside. This means that such data may be transferred to or accessed from jurisdictions other than the country in which you use WonderMaker's products or services. These jurisdictions may adopt different data protection laws or such laws may not exist.

6.3 WonderMaker will retain your data only for as long as necessary to fulfill the purposes set forth in these Terms and the Privacy Policy, unless a longer retention period is required or permitted by law. WonderMaker will take all appropriate technical and organizational steps to prevent unauthorized access to or disclosure of your data, but it remains important to note that no security measure is completely reliable.
7. Product updates

7.1 In order to provide you with a better user experience, WonderMaker may provide you with product update services, including, but not limited to, system software updates, 3D printing model updates, and so on. The purpose of this product update service is to improve the performance, safety and reliability of the products and equipment. Product updates can be installed in different ways. Software updates include bug fixes, system software updates, 3D printing model updates and performance enhancements.

7.2 WonderMaker is committed to ensuring that our products have a long lifespan by releasing software updates from time to time that contain bug fixes, new features and security updates. We are committed to providing guaranteed software updates for a period of five years (from the time of product release) that include exciting new features and critical bug fixes, among other things, to enhance the user experience.
During the aforementioned five-year period, we will routinely provide software updates that add new features to further enhance the user experience, as well as fix any bugs that may exist at that time. After this period, we will continue to bring updates with additional enhancements as appropriate, as long as there are features suitable for integration that the printer can support.
WonderMaker is also committed to providing software security updates for a period of no less than seven years, given the evolving nature of digital threats and the importance of security, and we will continue to provide updates for security vulnerabilities throughout the product lifecycle if we discover new security issues that need to be fixed.

7.3 Replacement or supplemental product updates provided by WonderMaker are subject to these Terms, unless such updates are accompanied by separate terms of use, in which case the latter will apply. If you decide not to download an update provided by WonderMaker, you understand and acknowledge that you may be placing the Product at serious security risk and may render the Product unavailable or unstable. Some product features may be limited by the version of the software and updating to the latest version of the software may enhance your user experience.

7.4 Your WonderMaker Product will automatically search for and download new update packages to provide you with timely updates. These updates are designed to address network security vulnerabilities and prevent new threats, so it is important to receive and install security-related system updates in a timely manner. Because of the importance of these updates, your product may block new print jobs before installing an update and will provide an update notification immediately to help keep you informed.
8. Services for This Product

8.1 The Product provides you with access to the relevant WonderMaker and third-party applications and services (collectively and individually, the "Services") that are bundled with the Product. However, due to the regional nature of some of the Services, these Services may not be available in all languages or in all regions, and certain features may vary from region to region, may be limited, or may not be available from your service provider. In addition, you understand and agree that certain features of the Products may also be affected or limited by device hardware and data access and may not be available on all Products.

8.2 In order to ensure and enhance your user experience, this product has prepared system services for you. The specific content of each service under this product is provided by WonderMaker and its affiliates/licensees according to the actual situation. WonderMaker and its affiliates/licensees may make changes to the services they provide, and the content of the services provided may change at any time.

WonderMaker Cloud,
WonderMaker Cloud is to provide you with the basic functions to use the WonderMaker Cloud service. These basic features include the WonderMaker account management features. These features may not be available in all regions/countries and in all languages. Use of these basic features requires Internet access and requires you to register for a WonderMaker Account and accept the additional terms and conditions of the basic services listed above.

Health Management System,
Health Management System is a service that automatically diagnoses the health status of your equipment for you. You can use the health management system to discover and check the current working status of the various components of your device, as well as to see how to deal with any problems you encounter. However, you understand that due to technical limitations and other various reasons, WonderMaker does not guarantee that the aforementioned features can detect all problems completely and accurately.
9. Third-party Software Statements
You expressly understand and agree that WonderMaker Products support the execution of generic G-code files, but do not guarantee the availability of G-code generated by third-party software for any period of time, and will not be liable for damage to the Product resulting from running G-code generated by third-party software on WonderMaker Devices.
10. Changes to These Terms
We may update these Terms from time to time. We will provide you with appropriate notices as appropriate. For example, we may display relevant notices on the relevant services or our website, or send you email or device notifications. You can find the date the Terms were last updated at the top of the page. Please also visit our website periodically to review any changes to the Terms. If you continue to access or use the Service or Products after the effective date of any update to the Terms, you accept the new Terms. If you do not agree to the new Terms, you must stop accessing or using the relevant service or product.
11. Termination and Continuing Effectiveness

11.1 These Terms are effective from the first day you install the Software. If you fail to comply with any of the terms or conditions of these Terms, your account may be deactivated and use of the Product may be restricted or discontinued. Upon deactivation of your account, you must immediately stop using the Product and remove all copies of the Software and related materials that have been copied and/or installed on your WonderMaker device or computer.

11.2 6, 12 and 13 shall survive the termination of the present articles.
12. Exclusion of Liability

12.1 You acknowledge that this product is provided "as is" without warranty of any kind, either express or implied, and to the fullest extent permissible by applicable law, neither WonderMaker, its licensors/affiliates, nor the copyright holders make any representations or warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, satisfactory quality, fitness for a particular purpose, confidentiality, and non-infringement of third party rights, fitness for a particular purpose, accuracy, confidentiality, and non-infringement of third party rights. Neither WonderMaker nor any other party warrants that the functions contained in the Product will meet your requirements or that the operation of the Product will be uninterrupted or error free. all responsibility and risk for choosing the product to achieve the desired results, and for installing, using, and obtaining results from the product, is assumed by you.

12.2 You further acknowledge that during the process of printing, calibrating, and manipulating the Equipment, it is not permitted to extend body parts or objects into the interior of the Equipment in order to avoid the potential risk of burns or entrapment, and that you assume all responsibility and risk for any personal injury or equipment damage resulting therefrom.
13. Limitation of Liability

13.1 WonderMaker is not responsible for problems with the use of the products caused by abuse, misuse or unauthorized modifications.

13.2 To the extent not expressly prohibited by applicable law, WonderMaker and its employees, licensors or affiliates shall not be liable for any loss of profits, revenues, lost sales, loss of data or cost of procurement of substitute goods or services, property damage, personal injury, business interruption, loss of business information, or any special, direct, indirect, incidental, economic, punitive, special, or consequential damages, whether based on any theory of liability (contract, tort, or otherwise), arising out of the use of, or the inability to use, this product. On no theory of liability (contract, tort, negligence or otherwise) will WonderMaker, its employees, licensors or affiliates be liable, even if they have been advised of the possibility of such damages. some jurisdictions do not allow limitations of liability for personal injury, incidental or consequential damages, etc. this limitation may not apply to you.

13.3 The limit of WonderMaker's total liability to you for all damages (except in the case of personal injury or death caused by WonderMaker's negligence, subject to applicable law) will not exceed the price you paid for the WonderMaker Product.

13.4 The laws of some countries do not allow the exclusion or limitation of certain warranties, guarantees or liabilities in the Terms. If these laws apply to you, then all or part of the exclusions or limitations set out in this may not apply to you and you may have additional rights. Nothing in these Terms affects statutory rights to which you are entitled as a consumer or which you cannot agree to vary or waive by contract.
14. Technical Support
Except as expressly set forth in the WonderMaker Warranty Policy (details of which you can review the After-Sales Policy at https://www.wondermaker3d.com), WonderMaker is not obligated to provide you with any technical support services other than those required by law for the products described in these Terms. No oral or written information or advice given by WonderMaker or an authorized representative of WonderMaker shall create any warranty.
15. Export Controls
You may not use or otherwise export or re-export WonderMaker Products except as authorized by applicable law and the relevant laws of the jurisdiction in which the WonderMaker Products were acquired.

17. Dispute Resolution and Governing Law
The validation, interpretation, modification, fulfillment and dispute settlement of these Terms shall be governed by the laws of the People's Republic of China. If any dispute arises regarding the content or fulfillment of these Terms, it shall be resolved through friendly negotiations. If the dispute cannot be resolved through negotiation, both WonderMaker and you may submit the dispute to the China International Economic and Trade Arbitration Commission (CIETAC) for arbitration in accordance with the arbitration rules of CIETAC at the time of the application for arbitration. The arbitration tribunal shall consist of three (3) arbitrators. WonderMaker and you shall each have the right to appoint one arbitrator, and the third arbitrator shall be appointed by CIETAC. The language of the arbitration shall be English and the arbitration shall take place in Shanghai, China. All arbitrators must be proficient in English. The arbitration award shall be final and binding on WonderMaker and you.
18. Complete Articles
These Terms and the Privacy Policy constitute the entire agreement between you and WonderMaker governing your use of the Products and will supersede any prior agreements between you and WonderMaker regarding the use of the Products. You may also be subject to other applicable terms and conditions when using or purchasing open source software, third party content, or other services from WonderMaker.
